Welcome to Kick DTF.

Kick DTF is a brand and trade name operated by Kick Print, LLC. Kick Print, LLC is the legal entity and contracting party for all purchases, transactions, products, and services offered through Kick DTF and KickDTF.com.

Throughout these Terms of Service (“Terms”), references to “Kick DTF,” “we,” “us,” or “our” mean Kick Print, LLC, doing business as Kick DTF, unless the context specifically indicates otherwise.

References to “Customer,” “you,” or “your” mean the individual or business accessing our website, submitting artwork, placing an order, or purchasing products or services from Kick Print, LLC through Kick DTF.

These Terms govern your use of KickDTF.com and your purchase and use of products and services offered by Kick Print, LLC through the Kick DTF brand.

By accessing our website, submitting artwork, placing an order, or purchasing products or services from us, you acknowledge that you have read, understood, and agreed to these Terms.

Please review these Terms carefully before placing an order.

1. OUR PRODUCTS AND SERVICES

Kick Print, LLC, through the Kick DTF brand, provides custom Direct-to-Film (“DTF”) heat transfers and related products and services.

Our transfers are manufactured based upon artwork, specifications, sizes, quantities, layouts, and other information submitted or approved by the customer.

Because DTF transfers are custom-manufactured specifically for each customer's order, certain return, cancellation, and refund policies applicable to ordinary retail merchandise may not apply to custom-produced products, except where otherwise required by law.

2. CUSTOMER-SUPPLIED ARTWORK

Customers are responsible for carefully reviewing all artwork before submitting it for production.

This includes, but is not limited to:

Spelling
Grammar
Names and numbers
Artwork dimensions
Transfer dimensions
Image resolution
Colors
Transparency
Background removal
Orientation
Placement
Gang sheet layout
Spacing
Design accuracy
Quantity and duplication of designs

Kick Print, LLC is not responsible for errors contained within customer-supplied or customer-approved artwork.

If we manufacture the transfer according to the artwork, file, dimensions, or layout submitted or approved by the customer, the product will generally be considered correctly produced even if the customer's artwork contains an error.

Customers should carefully review all artwork before completing an order.

3. ARTWORK OWNERSHIP AND AUTHORIZATION

By uploading, submitting, emailing, transmitting, or otherwise providing artwork or other content to Kick Print, LLC or Kick DTF, you represent and warrant that you have the legal right to reproduce and use that content.

You represent that you either:

Own the submitted artwork or content; or
Have obtained all licenses, permissions, releases, authorizations, or other legal rights necessary to reproduce and use it.

This requirement applies to, without limitation:

Copyrighted artwork
Trademarks
Business logos
Brand names
Photographs
Illustrations
Characters
Sports logos
School logos
Organization logos
Names
Likenesses
Licensed artwork
Other intellectual property or proprietary content

Kick Print, LLC does not independently verify ownership, licensing, or authorization for every piece of customer-submitted artwork.

Our acceptance, processing, or production of an order does not constitute a representation or determination by Kick Print, LLC that the customer possesses the legal rights necessary to reproduce the submitted artwork.

The customer remains solely responsible for obtaining all necessary rights and permissions.

4. INTELLECTUAL PROPERTY CLAIMS AND INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kick Print, LLC, including its owners, members, managers, employees, contractors, agents, representatives, successors, and affiliates, from and against claims, demands, damages, judgments, liabilities, losses, costs, and reasonable attorneys' fees arising from or relating to content or artwork submitted by you.

This includes claims involving:

Copyright infringement
Trademark infringement
Unauthorized reproduction
Unauthorized use of a person's name or likeness
Right-of-publicity claims
Licensing disputes
Other intellectual property or proprietary-right claims

Kick Print, LLC reserves the right to refuse, suspend, or cancel any order that we reasonably believe may violate applicable law or another party's rights.

5. ARTWORK QUALITY

DTF printing reproduces customer-supplied artwork. The quality of the finished transfer is therefore substantially dependent upon the quality of the artwork provided to us.

Low-resolution, pixelated, blurry, improperly formatted, poorly designed, or otherwise low-quality artwork may result in corresponding imperfections in the finished transfer.

Unless Kick Print, LLC specifically agrees to provide artwork or design services, we are not responsible for correcting, improving, recreating, redrawing, or otherwise modifying customer-supplied artwork.

Submitting artwork for production constitutes the customer's approval of that artwork unless otherwise agreed in writing.

6. GANG SHEETS

Customers who create, arrange, or upload their own gang sheets are responsible for the entire gang sheet layout.

This includes:

Artwork dimensions
Transfer sizing
Spacing between designs
Orientation
Image quality
Transparent backgrounds
Placement
Number of designs
Duplicate designs
Overall sheet configuration

Kick Print, LLC is not responsible for errors contained within customer-created gang sheets.

Customers should carefully inspect the entire gang sheet before submitting an order.

If a gang sheet is printed according to the file submitted by the customer, errors contained within the customer's gang sheet generally do not constitute a manufacturing defect.

7. SIZE AND DIMENSION VARIATIONS

Customers are responsible for selecting and verifying the requested dimensions of their transfers.

Minor variations in dimensions may occur during printing, curing, processing, trimming, or other manufacturing processes.

Unless otherwise expressly agreed in writing, minor dimensional differences that are customary or unavoidable within the printing and manufacturing process are not considered defects.

Customers requiring highly specific dimensional tolerances should contact us before placing an order.

8. COLOR VARIATION

Colors displayed on computer monitors, phones, tablets, and other digital devices may differ from the colors of the finished transfer.

Color appearance may vary because of factors including:

Monitor calibration
Screen brightness
RGB-to-CMYK conversion
Artwork color profiles
Ink characteristics
Printing equipment
Film
Adhesive
Garment color
Fabric composition
Heat application
Lighting conditions
Other manufacturing variables

Kick Print, LLC does not guarantee an exact color match to a customer's monitor, another printer's output, previous orders, Pantone colors, or other physical or digital color references unless a specific color-matching service has been expressly agreed upon in writing.

Reasonable color variation is not considered a manufacturing defect.

9. DTF APPLICATION AND PRESSING

Proper application is essential to the performance of DTF transfers.

Customers are responsible for using appropriate heat-press equipment and following the current application instructions provided by Kick DTF.

Application results can be affected by numerous factors outside our control, including:

Heat press temperature
Actual platen temperature
Pressure
Pressing time
Peel technique
Repressing technique
Garment material
Fabric composition
Fabric coatings or treatments
Moisture
Heat press calibration
Washing
Drying
Customer production methods

Kick Print, LLC cannot control the customer's equipment, garments, application procedures, or production environment after transfers are delivered.

Accordingly, we cannot guarantee identical application results under every possible production condition.

10. TEST BEFORE PRODUCTION

Customers should always test transfers before beginning a full production run.

Before applying an entire order of transfers, customers should apply and evaluate a test transfer using the actual garment or material, equipment, temperature, pressure, and process intended for production.

If a transfer does not appear to be applying or performing correctly, STOP PRODUCTION and contact Kick DTF before continuing.

Continuing production after discovering, or reasonably having the opportunity to discover, a potential problem may limit the remedies available for additional transfers or merchandise affected after the problem became apparent, to the extent permitted by applicable law.

11. GARMENTS, MERCHANDISE, LABOR, AND CONSEQUENTIAL LOSSES

Kick Print, LLC manufactures and sells DTF transfers. We generally do not control the garments, merchandise, blanks, equipment, or application process used by the customer.

To the fullest extent permitted by applicable law, Kick Print, LLC is not responsible for the cost or replacement of garments, apparel, merchandise, blanks, or other products onto which transfers are applied.

Kick Print, LLC is also not responsible, to the fullest extent permitted by law, for:

Customer labor
Employee time
Production costs
Lost production time
Production downtime
Lost profits
Lost revenue
Missed deadlines
Customer refunds
Lost customers
Event-related losses
Contractual penalties
Other incidental, indirect, special, or consequential damages

If we determine that transfers were defective when supplied, our responsibility will generally be limited, at our option and subject to applicable law, to replacing the affected transfers, issuing store credit, or refunding the amount paid to Kick Print, LLC for the affected transfers.

This is one reason customers are required to test transfers before beginning a complete production run.

12. DEFECTIVE TRANSFERS AND REPRINTS

Kick Print, LLC stands behind the quality of the transfers we manufacture.

If you believe your transfers contain a manufacturing defect, contact Kick DTF promptly after discovering the issue.

We may require information including:

Order number
Description of the problem
Photographs
Video showing the issue
Pressing temperature
Pressing time
Pressure information
Heat press information
Garment or material information
Washing information, if applicable
Samples of affected transfers
Other information reasonably necessary to investigate the issue

Customers should retain unused transfers while a claim is being evaluated.

We may request that samples or unused transfers be returned for testing or evaluation.

If Kick Print, LLC determines that the transfers contained a manufacturing defect when supplied, we may, at our discretion and subject to applicable law:

Reprint the affected transfers;
Issue store credit; or
Refund the purchase price paid for the affected transfers.

Normal variations inherent to custom printing, including reasonable variations in color or dimensions, are not necessarily manufacturing defects.

13. RETURNS AND REFUNDS

Because our DTF transfers are custom manufactured according to customer-provided artwork and specifications, custom printed products generally cannot be returned, exchanged, or refunded because of:

Customer error
Incorrect artwork
Spelling errors
Incorrect sizing
Incorrect quantities selected
Change of mind
Ordering the wrong product
Poor-quality customer artwork
Incorrect gang sheet layouts
Customer application errors
Improper heat press settings
Failure to follow application instructions

Nothing in these Terms eliminates any refund, replacement, cancellation, or other rights that cannot legally be waived.

If Kick Print, LLC makes a verified manufacturing or production error, we will provide an appropriate remedy consistent with these Terms and applicable law.

14. ORDER CHANGES AND CANCELLATIONS

Because Kick DTF offers fast production, orders may enter production shortly after being submitted.

Once production has begun, an order generally cannot be changed or canceled.

Customers who discover an error after placing an order should contact us immediately.

We will attempt to accommodate a requested change when reasonably possible, but we cannot guarantee that an order can be stopped or modified after submission.

If production has not begun, Kick Print, LLC may permit an order modification or cancellation at its discretion, subject to applicable law.

15. TURNAROUND TIMES

Production and turnaround times displayed or communicated by Kick DTF are estimates unless expressly identified by Kick Print, LLC as guaranteed.

Production turnaround time does not necessarily include shipping or carrier transit time.

Production may occasionally be affected by circumstances including:

Equipment issues
Unusually high order volume
Artwork problems
Supply interruptions
Power or utility interruptions
Severe weather
Carrier disruptions
Labor disruptions
Acts of God
Other circumstances beyond our reasonable control

Nothing in this section limits any cancellation, delay-notification, refund, or other rights provided by applicable law.

16. SHIPPING AND DELIVERY

Customers are responsible for providing complete and accurate shipping information.

Kick Print, LLC is not responsible for delivery problems or additional costs caused by incorrect or incomplete shipping information supplied by the customer.

Once an order has been transferred to a third-party shipping carrier, delivery timing and handling may be affected by circumstances outside our control.

Carrier delivery estimates are not guarantees made by Kick Print, LLC unless we expressly state otherwise in writing.

If an order appears to have been lost or damaged during shipment, customers should contact us promptly so that we can investigate the shipment and determine the appropriate resolution.

17. CUSTOMER DEADLINES AND EVENTS

Customers purchasing transfers for events, customer orders, product launches, production schedules, fundraisers, deadlines, or other time-sensitive purposes are responsible for allowing adequate time for both production and shipping.

Unless Kick Print, LLC expressly agrees in writing to a guaranteed deadline, we are not responsible for consequential losses resulting from a customer's deadline, event date, production commitment, or resale obligation.

18. PRICING AND WEBSITE ERRORS

Kick Print, LLC attempts to provide accurate product descriptions, pricing, promotions, shipping information, and other information through KickDTF.com.

However, typographical, technical, pricing, or other errors may occasionally occur.

Subject to applicable law, Kick Print, LLC reserves the right to correct errors and to cancel or decline orders affected by an obvious error.

If we cancel an order after payment because of such an error, we will refund the amount paid for the canceled portion of the order.

19. PROMOTIONS, DISCOUNTS, AND FREE SHIPPING

Promotional offers, discount codes, coupons, free shipping offers, and other promotions may be subject to additional terms and restrictions.

Unless otherwise stated, promotions:

Cannot be combined with other promotions;
Have no cash value;
May be limited to specific products or customers;
May have minimum purchase requirements;
May be limited by date or availability; and
May be modified or discontinued as permitted by applicable law.

Kick Print, LLC reserves the right to reject fraudulent, abusive, duplicated, or unauthorized use of promotional offers.

20. COMMERCIAL USE AND RESALE

Many Kick DTF customers purchase transfers for commercial decorating, resale, contract printing, fulfillment, or other business purposes.

Customers are responsible for determining whether our products are appropriate for their intended application.

Commercial customers should conduct appropriate testing before beginning production.

Kick Print, LLC does not guarantee the profitability, resale performance, suitability, or commercial success of transfers for any customer's particular business or application.

21. PROHIBITED USES

You may not use KickDTF.com or the products and services of Kick Print, LLC for unlawful or fraudulent purposes.

You may not knowingly submit content that violates applicable law or infringes another party's rights.

Kick Print, LLC reserves the right to refuse service, suspend an order, or cancel an order when we reasonably believe the transaction involves:

Fraud
Unauthorized payment activity
Illegal activity
Intellectual property infringement
Abuse of our systems
Threats or unlawful conduct
Other prohibited activity

22. FRAUD AND PAYMENT VERIFICATION

Kick Print, LLC reserves the right to review transactions for suspected fraud or unauthorized payment activity.

We may request additional identification, authorization, or payment verification before processing or shipping an order.

We may refuse or cancel orders that we reasonably believe are fraudulent, unauthorized, or present an unacceptable payment risk.

Any refund resulting from such cancellation will be handled in accordance with applicable law and applicable payment-processing requirements.

23. CHARGEBACKS AND PAYMENT DISPUTES

Customers who believe there is a problem with an order are encouraged to contact Kick DTF so that we have an opportunity to investigate and resolve the issue.

Nothing in these Terms limits any lawful rights a customer may have to dispute a payment with a card issuer or payment provider.

Knowingly submitting false information, engaging in payment fraud, or initiating a fraudulent payment dispute may result in refusal of future service and the exercise of any remedies available to Kick Print, LLC under applicable law.

24. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KICK PRINT, LLC AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, AFFILIATES, AND SUCCESSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE PURCHASE, APPLICATION, USE, OR PERFORMANCE OF OUR PRODUCTS OR SERVICES.

This includes, without limitation:

Lost profits
Lost revenue
Lost business
Production downtime
Labor costs
Customer merchandise
Garments or blanks
Missed deadlines
Lost customers
Business interruption

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF KICK PRINT, LLC ARISING FROM OR RELATING TO A PRODUCT, ORDER, OR TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO KICK PRINT, LLC FOR THE PRODUCT OR PORTION OF THE ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit certain limitations or exclusions of liability. Where a limitation or exclusion is prohibited, this section will apply only to the maximum extent permitted by applicable law.

25. DISCLAIMER OF WARRANTIES

Except for warranties expressly provided by Kick Print, LLC or warranties that cannot legally be excluded, our products and services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by applicable law, Kick Print, LLC disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties, remedies, or consumer protections that cannot legally be waived.

26. WEBSITE AVAILABILITY

Kick Print, LLC does not guarantee that KickDTF.com will always be uninterrupted, error-free, secure, or available.

We may modify, suspend, discontinue, maintain, or update portions of our website, products, or services from time to time.

27. THIRD-PARTY SERVICES

KickDTF.com may use or integrate services provided by third parties, including Shopify, payment processors, shipping carriers, software providers, applications, and other service providers.

Kick Print, LLC is not responsible for the independent acts, omissions, availability, policies, or services of third parties except to the extent required by applicable law.

Use of certain third-party services may also be subject to that provider's terms and policies.

28. PRIVACY

Your use of KickDTF.com is also subject to our Privacy Policy.

Please review our Privacy Policy for information concerning how personal information may be collected, used, stored, processed, and disclosed.

29. OTHER STORE POLICIES AND APPLICATION INSTRUCTIONS

Our Refund Policy, Shipping Policy, Privacy Policy, product-specific instructions, application instructions, and other policies posted on KickDTF.com are incorporated into these Terms where applicable.

Customers are responsible for reviewing the current application instructions applicable to the product they purchase.

If product-specific application instructions conflict with general application information contained elsewhere on our website, the more specific and current product instructions will generally control with respect to proper application.

30. KICK PRINT, LLC AS THE CONTRACTING PARTY

Kick Print, LLC is the legal entity offering, selling, manufacturing, and providing the products and services marketed under the Kick DTF brand and through KickDTF.com.

Kick DTF is a trade name and brand operated by Kick Print, LLC and is not intended by these Terms to constitute a separate contracting entity from Kick Print, LLC.

Any agreement created through the purchase of products or services from Kick DTF or KickDTF.com is an agreement between the customer and Kick Print, LLC.

Any payment made for products or services offered through Kick DTF is payment for products or services provided by or on behalf of Kick Print, LLC.

Any rights, protections, limitations of liability, indemnification rights, remedies, or other contractual rights granted to “Kick DTF” under these Terms are intended to benefit and be enforceable by Kick Print, LLC.

31. GOVERNING LAW

These Terms and any dispute arising from or relating to KickDTF.com, Kick DTF, Kick Print, LLC, our products, services, orders, or transactions will be governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any legal proceedings arising from these Terms will be brought in a court of competent jurisdiction as permitted by applicable law.

32. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, void, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law.

The remaining provisions will continue in full force and effect.

33. WAIVER

The failure of Kick Print, LLC to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

34. CHANGES TO THESE TERMS

Kick Print, LLC reserves the right to update or modify these Terms from time to time.

The version of the Terms posted on KickDTF.com at the time an order is placed will generally govern that transaction, except where otherwise required by applicable law.

The “Last Updated” date at the beginning of these Terms identifies when the Terms were most recently revised.

35. ENTIRE AGREEMENT

These Terms, together with our applicable Refund Policy, Shipping Policy, Privacy Policy, product-specific policies, application instructions, and any other terms expressly incorporated by reference, constitute the agreement between the customer and Kick Print, LLC regarding the use of KickDTF.com and the purchase of products and services offered through Kick DTF, except where a separate written agreement signed by Kick Print, LLC expressly provides otherwise.
